You retain all intellectual property rights in your User Content. You are solely responsible for your User Content and the consequences of posting it. Aether does not endorse any User Content and takes no responsibility for it.
By posting User Content on the Service, you grant Aether a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to host, store, reproduce, distribute, communicate, modify, adapt, and display your User Content solely for the purposes of operating, providing, and improving the Service. This licence is limited in scope to Service operation and does not permit Aether to use your content for advertising, sale, or any purpose unrelated to the Service.
This licence terminates when you delete your User Content or account, except to the extent your content has been shared by others and they have not deleted it, or where applicable law requires retention.

Aether reserves the right, but not the obligation, to review, monitor, remove, or disable access to any User Content at any time, without prior notice, at its sole discretion. Aether will not be liable for any action taken or not taken with respect to User Content. Users may report inappropriate content via the in-app reporting feature.
If you believe that your copyrighted work has been infringed on the Service, please send a notice to support@aether.app with the subject "DMCA Notice" including: a description of the copyrighted work, the URL of the infringing content, your contact details, a statement of good faith belief, and your signature.
All rights, title, and interest in and to the Service — including the Aether name, logo, design, user interface, code, algorithms, features, and all content created by Aether — are owned by or exclusively licensed to Aether and are protected by applicable intellectual property laws.
Aether grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes, subject to these Terms. No other licence is granted.
You may not use, copy, reproduce, distribute, publish, modify, create derivative works of, or exploit any portion of the Service or Aether's intellectual property without prior express written permission from Aether.
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy. Please review it carefully.
The Service integrates with third-party services including Spotify, ZegoCloud, and Google Firebase and Gemini. Your use of those services is subject to their own terms of service and privacy policies. Aether is not responsible for the availability, content, accuracy, or practices of third-party services, and does not endorse them.
Aether makes no warranty and accepts no liability arising out of your use of any third-party services accessed through or in connection with the Service.
Aether may, at its sole discretion and without prior notice or liability, immediately suspend, restrict, or permanently terminate your account and access to the Service for any reason, including but not limited to:
You may terminate your account at any time by navigating to Settings → Delete Account in the app, or by submitting a request at aether-d1674.web.app/account-delete.
Upon termination, your right to use the Service ceases immediately. We will process the deletion of your account and personal data within 30 days in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
AETHER DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.
Aether is not responsible for User Content posted by other users and does not endorse it. Use of the Service and reliance on any User Content is at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AETHER AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF, OR INABILITY TO USE, THE SERVICE; (B) ANY CONTENT OBTAINED FROM THE SERVICE; (C) UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE.
AETHER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO AETHER IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100 (ONE HUNDRED US DOLLARS).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless Aether and its directors, officers, employees, agents, and successors from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including reasonable legal fees) arising from: (a) your use of or access to the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (e) any claim that your User Content caused damage to a third party.
Aether reserves the right, at its own expense, to assume exclusive defence and control of any matter subject to indemnification by you, in which case you will cooperate fully with Aether in asserting any available defences.
Before initiating any formal proceedings, you agree to contact Aether at support@aether.app and attempt to resolve any dispute informally for a period of at least 30 days.
If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claim qualifies. The arbitration will be conducted in accordance with the rules of a mutually agreed arbitration body.
You agree that any arbitration will be conducted on an individual basis only, and not as a class, consolidated, or representative action. To the extent permitted by law, you waive your right to participate in a class action lawsuit.
Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
These Terms and any dispute arising out of or related to them or the Service will be governed by and construed in accordance with applicable law, without regard to conflicts of law principles. For users in the European Union, mandatory consumer protection provisions of your local law apply and are not affected by this clause.
Any legal proceedings not subject to arbitration shall be brought exclusively in a court of competent jurisdiction, and you consent to the personal jurisdiction of such court.
These Terms, together with the Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and Aether regarding the Service and supersede all prior agreements.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
Aether's failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of Aether to be effective.
You may not assign or transfer your rights or obligations under these Terms without Aether's prior written consent. Aether may freely assign these Terms in connection with a merger, acquisition, or sale of assets.
Aether will not be liable for any delay or failure to perform resulting from circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of government, labour disputes, or failures of third-party infrastructure.
These Terms are for the sole benefit of you and Aether and do not create any rights in any third party.
Aether reserves the right to modify these Terms at any time. When we make material changes, we will:
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Service and may delete your account.
